Two different things. Plus they go to the HEART of the matter. Your
statement this morning was made in a cold state. It is rational and
correct. The earlier statement was made in a hot state. It is a
sentiment based on emotion and passion. Justice as much as possible
needs to be devoid of decisions based on emotion. As we erode our
civil liberties the barriers that make us civilized cease to be
barriers. Justice is blind and it is also dispassionate. Too often in
our history justice made in a "hot" state has resulted in abominations.

The problem with putting your name on a list is two fold. First doing
it in perpetuity is cruel and unusual punishment. Keep in mind that it
is not JUST rapists and child molesters whose names are on this list.
This includes ALL sex offenders. That can result in some very
unintended consequences. For instance there have been men arrested for
cruising and have been put on the sex offender registry. Secondly,
lets look at a case from Johnson city Tennessee.

In Short: An undercover investigation into public sex in Johnson City
parks led to the arrest of 40 men in two weeks. there was a location
known as "the man cave" where men would routinely cruise for sex.


The names of EVERY suspect arrested was published in the local
newspaper. ALONG with addresses and phone numbers. This is NOT
something they do in all cases. But the feeling was that sexual
offenders represent a "special" category. One person rightfully said
that what we have returned to is a day in the stocks. Soemthing that
has been considered untolerable by todays standards. The result:

Less than 24 hours after Johnson City police announced charges against
dozens of men allegedly involved in sex acts at city parks, one of
those accused is believed to have killed himself. A resident of
Newland, N.C., 55-year-old Jerry McCloud reportedly was found dead
inside his home around 10 a.m. Tuesday. Authorities told a source in
Avery County, N.C., that McCloud died from a self-inflicted gunshot
wound. His body reportedly was found by a family member.

Still we do not allow say... wild dogs to rip felons apart. We have a
an amendment preventing cruel and unusual behavior. Even in cases
where we resort to taking a life (an issue I also deeply oppose)we
have to follow guidelines involving cruel and unusual punishment.

I was not critical of your use of caps. I use caps. I was saying that
no matter how much you emphasize what your saying it does not make it
true. Read caps as adamant. I am firm about critiquing format,
grammar, or spelling. It is a refuge of a small mind. I apologize for
the misunderstanding.

Actually I was in the military for eight years. Two tours in combat.
My partner is an ICU nurse, SHE has been so for 20 years.

No obviously I read what you write carefully. I never see misspelled
words because I can't spell worth a darn.

Actually Mario Cuomo answered this very well. In 1988 Dukakus was
asked in a debate what he would do if his wife were raped and
murdered. This question fell on the heels of being asked about the
death penalty. Dukakis did a poor job of answering. But Cuoma answered
it later...

If my wife were raped and killed I would hunt down the son of a bitch
and kill him. I would want him to suffer. But thats not justice. Our
justice system should be blind and impartial. It is not a justice
system based on passion or anger or revenge. If we give our system up
then we have given up the one thing that truly makes us a great nation.
